TERMS AND CONDITIONS
Art. 1 – General Provisions
1.1 Users access CookingWithLuca via the URL: https://www.5terrecooking.it/; users who intend to purchase a service through the website are required to register on the website in advance.
1.2 Browsing the site and submitting a purchase order imply acceptance of the Terms and Conditions and the Privacy Policy adopted by the site and set forth herein.
1.3 By accessing the site for the purpose of making a purchase, the User may:
- view the services available for purchase;
- submit a request for information via a form in which to enter essential details: First Name, Last Name, phone number, email address, and message (specifying the type of experience for which information is requested and the number of people);
- enter personal data;
- review the services and the price per guest;
- make reservations, cancellations, and payments.
1.4 Experiences that can be booked directly on this website (see Art. 2) are considered final only upon successful payment.
Failure to pay results in the automatic loss of the right to book and participate.
1.5 Reservations that do not include all required information will not be considered valid. If the user provides inaccurate or incomplete information, or if there is a dispute by the parties concerned regarding payments made, CookingWithLuca reserves the right not to activate or to suspend the experience until the outstanding payments or information have been resolved.
1.6 The payment receipt will be retained by CookingWithLuca for the time necessary to process the payment; the tax document, however, will be retained to comply with legal requirements.
1.7 Before accessing the experiences provided by the website, the user is required to read these General Terms and Conditions of Sale, which are deemed to be generally and unequivocally accepted at the time of payment.
1.8 CookingWithLuca reserves the right to cancel the experience for organizational reasons or other impediments. In such cases, participants will be contacted promptly and will have the option to choose a new date for the experience or receive a full refund.
CookingWithLuca is not responsible for any third-party costs, such as travel arrangements or accommodation.
Art. 2 – Products Offered
2.1 CookingWithLuca offers cultural and culinary experiences in the local area.
2.2 The offerings are detailed on our website at the following link: https://www.5terrecooking.it. The offer includes experiences for which you will be directed to partner websites where you can make a reservation. CookingWithLuca is in no way responsible for reservations made on partner websites.
2.3 These terms and conditions apply ONLY to Experiences booked on this website, and CookingWithLuca is not responsible for the Terms and Conditions of partner websites.
Art. 3 – Prices
3.1 The price of the experiences will be the one indicated on the website from time to time, except in cases of obvious error, and includes only what is explicitly stated in the descriptions of the services offered.
3.2 In the event of an error, CookingWithLuca will notify the purchaser as soon as possible, allowing for payment of the correct amount or cancellation. In any case, CookingWithLuca shall not be obligated to provide the item sold at the erroneously indicated lower price.
3.3 Prices on the website are VAT-exempt (“Transaction carried out pursuant to Art. 1, paragraphs 54 to 89 of Law No. 190/2014 – Flat-rate scheme”) unless otherwise indicated. Prices are subject to change at any time. Changes do not apply to reservations for which payment has already been made.
3.4 Once the user has selected the experience and the date, they will be redirected to a Stripe payment form where they can choose a payment method (see Section 5.2), confirm their details, and receive real-time confirmation of payment.
Art. 4 - What's Included or Excluded
INCLUSIONS
- Alcoholic Beverages: based on what is indicated in the experience sheets in the catalogue (consumers have to be at least 18 or more);
- All ingredients to prepare the recipes indicated in the experience sheets in the catalogue;
- All Fees and Taxes, Insurance.
EXCLUSIONS
- Breakfast, snacks, brunch, coffee and/or tea;
- Private transportation or pick up, Tickets for parking and/or transport;
- Infants and children under 10 years of age are not allowed and it is not permitted to bring animals;
- Since I take care of hygiene, bathroom facilities are not available at my home. - Please plan accordingly before your arrival;
- Total ban on smoking;
- Anything not expressly indicated above or in the experience sheets.
Art. 5 – Payment Methods
5.1. The user is required to pay the full amount prior to the experience. Upon receipt of the payment, CookingWithLuca will issue the guest a valid tax receipt and send it via email.
5.2 Payment of the Total Price indicated may be made using the payment methods accepted by CookingWithLuca and listed on the website. Specifically, payment can be made by credit card using Visa, Mastercard, Maestro, or other methods available on the Stripe payment form. Under no circumstances will the user be charged additional fees in connection with the chosen payment method.
5.3 To ensure maximum security, the user will complete the payment transaction via a secure connection and directly with the financial institution that manages the online payment system. The financial information (e.g., credit/debit card number, expiration date, security code) that the user provides for the payment transaction is encrypted and transmitted directly to the payment processor, without passing through the servers used by CookingWithLuca, which therefore has no access to such information and cannot save or store it.
5.4 In the event of a payment failure, the reservation will be canceled, and the contract shall in no case be deemed to have been concluded.
5.5 The user is solely responsible for the data entered and therefore warrants that they will use only credit cards over which they have lawful authority. CookingWithLuca is not liable for any fraudulent or unlawful use of credit cards that may be made by third parties at the time of payment by the user.
5.6 Payments for Services via bank transfer or any payment method other than those expressly indicated on the website will not be accepted.
5.7 If the user is a resident of Italy and wishes to receive an electronic invoice, they must request it during the purchase process and provide all necessary tax information. The invoice issued by CookingWithLuca will be sent via email and transmitted directly through the electronic exchange system, with a €2 revenue stamp added in accordance with legal requirements.
Art. 6 – Cancellation, Rescheduling, Delays, and Refund Policy
CANCELLATION
Reservations may be canceled with at least THREE (3) days’ notice prior to check-in.
If no notice is given, the course will be considered completed and will not be refundable or rescheduled.
RESCHEDULING
You may reschedule the date or time of your experience up to 72 hours before the scheduled start time.
If you reschedule an experience, the cancellation policy is based on the original purchase date of the experience.
LATE ARRIVALS
Please strictly adhere to the times provided at the time of booking. Please note that the reservation is non-flexible, and if you are more than 15 minutes late, your spot will be considered canceled and the full payment will be retained without exception.
All directions you need to arrive exactly at the experience location will be sent to you in advance; therefore, late arrivals beyond the maximum allowed time will not be accepted.
REFUNDS
100% refunds can only be issued if the cancellation is made THREE (3) days prior to the class date. If you book a cooking experience that falls within THREE (3) days of the date, the full payment is non-refundable.
In the event that a member of your group is unable to attend the booked cooking class or a member of your group checks in for the confirmed class and must leave during the class, the full payment will be retained.
Art. 7 – Participation of Adults and Minors
Minors under the age of 18 are permitted to participate provided they are accompanied by an adult and must always pay the full price;
Our experiences are centered on sharing the joy of cooking, and everyone actively participates in preparing dishes that can be shared together at the end. You may choose to limit your involvement during the preparation, but you will still be required to pay the full price for participation even if you do not cook.
Under NO circumstances is free participation in the experience permitted.
We recommend that you carefully review all booking details and remember that bringing non-paying guests (adults or children) is not permitted.
Art. 8 – Damage and Loss
Without exception, you agree to hold us and our staff harmless from any liability for any loss of personal property during the experience, or for any injury that you or others in your group may sustain as a result of your negligence or reckless behavior.
You will be required to reimburse us for any damage to property or injury to persons caused by your negligence.
Art. 9 – Intellectual Property Rights: “Cooking With Luca”
By accepting these terms, you consent to being photographed and filmed during the class.
NOTE: Consent to the use of your image may be revoked at any time, even if previously granted, by written notice.
These images are therefore the property of CookingWithLuca and may be used for marketing purposes.
Reproduction of the website’s content, images, and any unauthorized use is prohibited.
Exclusive ownership of all content belongs to OSTERIA MAITE' DI LUCA RIZZETTO.
