Art. 1 - General provisions
1.1 The user browsing this area accesses CookingWithLuca (accessible via the url: https://www.5terrecooking.it/); the user who intends to purchase a service through the site is not obliged to register in advance on the site itself.
1.2 The navigation and the transmission of a purchase order on the site imply the acceptance of the General Sales Conditions and Data Protection Policies adopted by the site indicated therein.
1.3 The User, by linking to the site for the purposes of purchase, may:
- view the services available for purchase, send availability request (through a form in which you enter the essential data: Name, Surname, Telephone number, e-mail, type of experience that requires availability and the number of people) and, only if yes, provide payment through a Pay-by_Link link.
- enter your personal data;
- check the Services, the price for each guest.
1.4 The booking to the cooking classes (hereafter referred to as "experiences") are considered definitive only at the time of payment.
Failure to pay means automatic loss of the right to book and participate.
1.5 Reservations that do not include all the requested data will not be considered valid. If the user communicates incorrect or incomplete data or even if there is a dispute by the interested parties about the payments made, CookingWithLuca will have the right not to activate or suspend the experience until the payment or data has been cleared.
1.6 The receipt of payment will be filed by CookingWithLuca for the time necessary to execute the same, the tax document will, instead, filed for the fulfillment of the law.
1.7 The user is obliged, before accessing the experiences provided by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of payment.
1.8 CookingWithLuca reserves the right to cancel the experience for organizational reasons or other impediments. In such cases, subscribers will be contacted promptly and will have the opportunity to choose a new date for the experience or receive a full refund.
We will not be responsible for any third party costs, such as travel arrangements or accommodation.
Art. 2 - Products offered
2.1 CookingWithLuca markets Cooking Experiences.
2.2 The offer is detailed on our website at the link: https://www.5terrecooking.it.
Art. 3 - Prices
3.1 The price of the experiences will be as indicated from time to time on the site, except where there is a manifest error and includes only those explicitly indicated in the tabs of the services offered.
3.2 In the event of an error CookingWithLuca will notify the purchaser as soon as possible by allowing payment at the right amount or cancellation. In any case, CookingWithLuca will not be obliged to supply the goods sold at the lower price wrongly indicated.
3.3 Site prices are exempt from VAT ("Transaction carried out pursuant to art. 1, paragraphs 54 to 89 of Law No. 190/2014 - Flat rate scheme") unless otherwise indicated. Prices may change at any time. Changes do not affect Bookings for which Payment has already been made.
3.4 Once the confirmation for the desired experience has been received, the user will receive an Pay-by-Link link to choose the payment method with which to pay, confirm the data and receive the confirmation of payment in real time. Once you have received the link, the customer will just click to access the payment page and enter your card details, in particular:
- PAN number (simply known as "card number", 16-digit);
- Expiry date (month/year);
- Security code (depending on the card has 3 or 4 digits).
Art. 4 - What's Included or Excluded
4.1. Inclusions
- Alcoholic Beverages: based on what is indicated in the experience sheets in the catalogue (consumers have to be at least 18 or more);
- All ingredients to prepare the recipes indicated in the experience sheets in the catalogue;
- All Fees and Taxes, Insurance.
4.2. Exclusions
- Breakfast, snacks, brunch, coffee and/or tea;
- Private transportation or pick up, Tickets for parking and/or transport;
- Infants and children under 14 years of age are not allowed and it is not permitted to bring animals;
- Since I take care of hygiene, bathroom facilities are not available at my home. Please plan accordingly before your arrival;
- Total ban on smoking;
- Anything not expressly indicated above or in the experience sheets.
Art. 5 - Payment methods
5.1. The User is required to pay in the form of an amount to be paid before the experience. CookingWithLuca upon receipt of the sum will issue the regular tax document to the Guest and send it by email.
5.2 Payment of the Total Price indicated may be made by means of payment accepted by CookingWithLuca and indicated on the website. In particular, it can be made by credit card, using the following circuits Visa, Mastercard, Maestro. In no case will the User be charged additional costs in relation to the chosen payment instrument.
5.3 To ensure maximum security, the User will carry out the payment transaction via secure connection and directly to the credit institution that manages the online payment system. The financial information (for example, the credit/debit card number, its expiration date, secret code) that you will use for the payment transaction is encrypted and transmitted directly to the payment provider, without transiting from the servers that uses CookingWithLuca which therefore has no access to such information, nor can save or store them.
5.4 In the event of failure of the payment process the Booking will be cancelled and the contract will not, in any case, be considered completed.
5.5 The User is solely responsible for the data entered, therefore guarantees to use only credit cards of which you have the legitimate availability. CookingWithLuca is not responsible for any fraudulent and illegal use of credit cards that may be made by third parties at the time of payment by the User.
5.6 Payments of experiences by bank transfer or other means of payment other than those expressly indicated on the Site will not be accepted.
5.7 If the User is resident in the Italian territory and wishes to receive the electronic invoice, he will be required to make a request during the purchase process and to provide all the necessary data (eg pec address). The invoice issued by CookingWithLuca will be sent by e-mail and transmitted directly through the exchange system according to the terms of the law.
Art. 6 – Cancellation, Rescheduling, Delay and Refund Policy
RESCHEDULING
You can reschedule the date or time of your experience up to 72 hours before the experience is scheduled to start.
If you reschedule an experience, the cancellation policy is based on the original purchase date of the experience.
DELAYS
You are kindly requested to accurately respect the timing indicated at the moment of your booking. Please remember that the time is not flexible and over 15 minutes delay your spot is considered cancelled and the full payment will be forfeited without exceptions.
Every indication you need to get exactly to the experience location will be sent to you in advance therefore delays will not be accepted after the expected time.
REFUNDS
In the case of cancellation the 20% + commissions will be retained and if you cancel a cooking class that falls on within 48 hours, full payment is non-refundable.
In the case of “NO SHOW” the course will be considered completed and will not be refundable or recoverable.
In the case that a member of your group will not be able to participate during the booked cooking class or a member of your group checks-in for the confirmed class and needs to leave during the lesson, the full payment will be collected.
Art. 7 – Participation of Adults and Minors
It is allowed the participation of minors under 18 years as long as they are accompanied by adults and are always paying.
Our experiences focus on sharing the joy of cooking and everyone is active in creating dishes that they can share together at the end of the class. You can limit your involvement during preparation but you will still have to pay for participation even if you don’t cook.
In no case is provided free participation in the experience.
We recommend that you carefully check all booking details and remember that it is not allowed to bring non-paying guests (adults or children).
Art. 8 – Damages and loss
Without exception you will keep us and our collaborators free from any liability for any loss of personal property during the experience, or for any injury or damage that you or others in your group suffer due to your negligence or dangerous behavior.
You will be required to refund any damage to objects or people caused by your negligence.
Art. 9 – Intellectual Property Rights: "Cooking With Luca"
By agreeing to these terms you consent to being photographed and filmed during the experience. These images are therefore owned by CookingWithLuca to be used for marketing purposes.
It is forbidden to reproduce the contents of the site, images and any use not expressly authorized. The exclusive ownership of all contents belongs to OSTERIA MAITE' DI LUCA RIZZETTO.
